The two that matter most. Property details shown here are indicative and are not a contractual offer — always confirm with us before acting. And a viewing request is a request: nothing is booked until a member of our team confirms it with you directly.

1. Agreement

By using the Sunny Casas app in ChatGPT, or its MCP server at mcp.sunnycasas.com, you agree to these Terms. If you do not agree, please do not use it. Our Privacy Policy forms part of these Terms.

2. Who we are

Sunny Casas, an estate agency registered in the Valencian Community under RAICV 5942, at Calle Patricio Zammit 1, 03182 Torrevieja, Alicante, Spain. Contact: info@sunnycasas.com, +34 691 160 120.

3. The service

The app lets you search Sunny Casas’ available property listings conversationally, view details and photographs, and send an enquiry or ask for a viewing. It is provided free of charge, with no account and no payment.

To keep it available to everyone, enquiries and viewing requests are rate-limited per email address and phone number. Requests beyond that limit are declined; it does not mean your earlier enquiry was lost.

4. Eligibility

You must be at least 16 years old to use this app. By using it you confirm that you meet that requirement.

5. No accounts

No account or sign-up is required. You are responsible for the accuracy of any information you submit, and for how you use the information the app returns. Anything held only in the view inside ChatGPT — such as which properties you selected to compare — is lost when you close it.

6. Property information is indicative, not contractual

This is the most important clause on this page.

Prices, availability, measurements, plot sizes, room counts, features, distances and photographs are supplied in good faith and drawn from our live inventory, including feeds from partner agencies and developers. They may contain errors or be out of date.
Nothing shown in the app is an offer, an invitation to treat, or any part of a contract.
Distances to beaches and golf courses are straight-line calculations from the property’s recorded coordinates. They are not walking or driving distances.
Measurements are as supplied by the vendor or source feed and have not been independently verified.
A property can be sold, reserved or withdrawn at any time, including between your search and your enquiry.
Descriptions may have been machine-translated and may not reflect the original Spanish exactly.

Always confirm details with Sunny Casas before making any financial commitment, travel arrangement or other decision. You should obtain independent legal and financial advice before purchasing property in Spain.

7. Enquiries and viewing requests

A viewing request submitted here is a request only. It is not a booking, a reservation or a confirmed appointment. A viewing exists only once a member of our team has contacted you and agreed a time.
Submitting an enquiry does not reserve a property or give you any priority or option over it.
Submit only your own contact details, and only details you are entitled to provide.
We aim to respond promptly but do not guarantee a response within any particular time.

8. Acceptable use

You must not:

Scrape, bulk-extract, mirror or systematically download our property data, or use it to build a competing database or listing service
Attempt to bypass rate limits, or submit false or automated enquiries
Attempt to access data the app does not return to you, or probe, disrupt or reverse-engineer the service
Submit another person’s contact details without their authority
Use the service unlawfully, or to harass, defraud or mislead anyone

We may block access and take legal action where these Terms are breached.

9. Intellectual property

The Sunny Casas name, logo, listing photography, property descriptions, the app and its underlying software are owned by Sunny Casas or its licensors. You may use the information the app gives you for your own personal, non-commercial purpose of finding a property. You may not reproduce, redistribute or publish our listing content without written permission.

10. AI disclaimer

You reach this service through ChatGPT, an AI system operated by OpenAI. Its responses are generated probabilistically and can be inaccurate, incomplete or misleading even where the underlying data is correct. It may summarise a property imprecisely, miscalculate, or state something we did not.

Treat the app as a way to find candidate properties, not as a source of definitive fact. Where ChatGPT’s summary and the listing on sunnycasas.com disagree, the website is authoritative; where the website and our office disagree, ask us. Sunny Casas is not liable for decisions made on the basis of AI-generated text.

11. Third-party services

Your use of ChatGPT is governed by OpenAI’s own terms, which apply to you independently of these Terms. We do not control ChatGPT’s behaviour, availability or how OpenAI handles your conversation.

12. Availability

The app is provided free and on a best-effort basis. We do not guarantee that it will be available, uninterrupted, error-free, or that any feature will be retained. We may change, suspend, rate-limit or withdraw it at any time without notice, and we are not liable for doing so.

13. Disclaimer of warranties

To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that property information or AI-generated output will be accurate, current or complete.

14. Limitation of liability

To the fullest extent permitted by law, Sunny Casas is not liable for indirect, incidental, special or consequential loss, or for loss of profit, opportunity or data, arising from your use of the app — including reliance on property information or AI-generated output, or a property becoming unavailable.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Some jurisdictions do not allow certain exclusions or limitations; where that is so, our liability is limited to the maximum extent the law permits and the limitations above may not apply to you.

These Terms do not affect the statutory rights you have as a consumer under Spanish or EU law, nor any separate agency or sale agreement signed with us — such an agreement governs that transaction, not this app.

15. Indemnity

You agree to indemnify Sunny Casas against claims, damages and reasonable costs arising from your breach of these Terms, your misuse of the service, or your submission of another person’s personal data without authority.

16. Governing law

These Terms are governed by Spanish law. Disputes are subject to the courts of Torrevieja, Alicante, Spain. If you use the app as a consumer resident in the European Union, you keep the protection of the mandatory consumer law of your country of residence and may bring proceedings in your local courts.

17. Changes

We may update these Terms. Material changes will be posted here with a new “last updated” date. Continued use after changes are posted constitutes acceptance of the revised Terms.
